Photographer Glen E. - Thomas Hawk's Digital Connection
Considering that nearly all of Thierry’s work is derivative and involves the wholesale appropriation of often famous artwork, this doesn’t surprise me in the least. I agree, it is a fine line, as appropriation is often an element of artistic evolution, as Warhol easily represents. However I find Thierry’s work particularly offensive in that he appears to make little effort to actually transform or reinterpret the images he chooses to appropriate; perhaps that was just the editorial perspective provided by ‘Exit Through the Gift Shop’, but in his case I can’t help but feel that this legal action may have been justified.
Interesting story – thanks for sharing!
On one your other points, I’m not worried about photographers suing artists who use stolen photos. In fact, I don’t really have respect for artists who show such a lack of originality. If they’re inspired to do something from a photo, what’s so hard about first contacting the photographer? If nothing else, it’s basic courtesy. If they can’t find the photographer, then move on to something else or come up with an original idea.
I fully support fair use but the use of both the Guetta image and the “Hope” poster were, in my opinion, not fair. Removing a background and making an image monochrome is not transformative. On the other hand, I think the use of the image did nothing to reduce the value of the original, a key test for fair use. I wonder if MBW even attempted to get permission to use the image in this way because had it been my image, I would have had no issue.
This is NOT a new trend. Warhol got called for his theft multiple times: he waved money at the problem and it went away.
What IS new is the gradual strengthening of the copyright laws which makes it easier and more financially reasonable to proceed against a thief. Thanks to Disney and its pet Senators, other than orphan works this is not a trend likely to reverse itself anytime soon. I guess we’ll find out if civilization can continue without the ability to make woodblocks of other people’s photographs and/or put crayon drawings of guitars on images to make the subjects look silly.
