Nigeria: Buhari-Jonathan - Issues As Tribunal Sets Stage for Trial
Abuja — LAST week, the Presidential Election Tribunal set stage for the pre-trial in the petition filed by Presidential Candidate of the Congress for Progressive Change (CPC), Gen. Muhammadu Buhari seeking to nullify the election of President Goodluck Jonathan on the grounds of substantial non-compliance with the provisions of the Electoral Act 2010.
Specifically, the court has directed the issuance of Forms TF 0007 (Pre- Hearing Notice) and TF 008 [Pre- Hearing Information] on counsel to both parties in the appeal. The documents contained relevant questions necessary to fast track the determination of the appeal.
For instance, questions regarding the number of witnesses to be called by both parties; relevant documents and exhibits to be tendered and other important questions that would be needed for the quick dispensation of the appeal.
The decision of the court was at the instance of the CPC whose counsel; Abubakar Malami along with some others moved an oral application for the forms to be formally issued to counsels in the matter in line with the provisions of the Electoral Act. Although, counsel already had copies of the forms, the CPC said it did not want to take chances since it was issued without the order of the court.
The legal team to President Jonathan, Chief Wole Olanikpekun (SAN), Dr. Alex Izinyon (SAN), Damien Dodo (SAN) Dabian Ajogwu, Ighodalo Imadegbelo, Chief Assam Assam, O.A. Omonuwa, Jude Nnodum and Paul Erokoro had raised objections to the application; describing it as unnecessary.
At the last sitting, the tribunal presided over by the President of the Court of Appeal; Justice Ayo Salami granted the application and directed the requisite forms be served on the parties through their respective counsels. As of date, no date has been fixed for the pre-hearing proceedings.
In the petition anchored on two grounds filed by Ebun Shotunde (SAN), Abubakar Malami (SAN) and Alasa Ismail, the CPC is further asking the tribunal to set aside the presidential election of April 16, 2011 and organize a fresh election between the CPC and the Peoples Democratic Party (PDP).
The CPC also wants the tribunal to hold that Jonathan and Sambo of the PDP were not duly elected by majority of lawful votes cast at the election.
The CPC stated that it shall prove at the hearing that there was substantial variation in the voters' register used by the INEC for the conduct of the presidential and governorship elections respectively and to that extent INEC and its chairman, Attahiru Jega unlawfully manipulated the register to the advantage of Jonathan and Sambo.
